1. Acceptance of Terms

By accessing the KeksGlobal platform or integrating our SDKs, you agree to be bound by these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. This is a legally binding agreement between KeksGlobal Observability & Incident Response Inc. and the legal entity you represent.

2. Eligibility and B2B Limitation

KeksGlobal services are exclusively available for Business-to-Business (B2B) professional use. By creating an account, you represent that you are an authorized representative of a valid business entity and that your use of our infrastructure is for professional monitoring, observability, and transactional communication purposes.

3. Service Scope and Availability

KeksGlobal provides a high-throughput transactional relay for system notifications. While we strive for 99.999% uptime, services are provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any aspect of the service at any time to maintain infrastructure integrity.

4. Account Responsibilities

• Credential Security: You are solely responsible for maintaining the confidentiality of your API keys and administrative credentials.
• Data Accuracy: You must provide accurate corporate information during the onboarding process.
• Usage Limits: Exceeding your plan's transactional volume may result in automatic rate-limiting or overage charges as defined in your service tier.

5. Intellectual Property

All technology, software, SDKs, and relay protocols utilized in the KeksGlobal network remain the exclusive property of KeksGlobal Inc. and its licensors. No license is granted to reverse-engineer or re-sell our infrastructure without explicit written consent.

6. Termination

We reserve the right to terminate or suspend your access immediately, without prior notice or liability, for any reason, including but not limited to a breach of the Acceptable Use Policy (AUP). Upon termination, your right to use the KeksGlobal SDKs and Relay will cease immediately.

7. Limitation of Liability

To the maximum extent permitted by law, KeksGlobal Inc. shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our monitoring services, even if we have been advised of the possibility of such damages.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
